
O’Donnell Case Granted Leave by Court of Appeals
The Court of Appeals, New York State’s highest court, granted leave to appeal to the employer in Matter of O’Donnell v. Erie County on the issue of whether the Appellate Division erred in affirming the Board’s decision that based on the April 2017 amendment to Workers’ Compensation law §15(3)(w), the claimant was no longer required to demonstrate labor market attachment. Congratulations to our own Matt Hoffman, who successfully petitioned the Court for leave to appeal.
