
Notice To Our Colleagues Regarding Service By Email and Notices Of Depositions
During the COVID-19 emergency and until the Governor’s Executive Order is lifted, Hamberger & Weiss LLP will accept service by email at recordsbuff@hwcomp.com or recordsroch@hwcomp.com. We would urge you to reciprocate with written confirmation that you are also accepting service by email at either of the above emails.
In the past, Hamberger & Weiss LLP has arranged for depositions and notified Independent Medical Examiners (IMEs) when cross-examination has been requested. We have filed affidavits with the WCB to extend the time to complete them when needed. However, WCB rules require that the party requesting cross-examination arrange the deposition and notify the provider and request extensions if needed.
This is to advise you that Hamberger & Weiss LLP will no longer notify IMEs of scheduled depositions. Our deposition coordinators will continue to be available to work with your offices to arrange acceptable dates and times when our attorneys can accommodate the depositions. Many of our clients have specific agreements for transcription services and as a result, we will arrange for the hearing reporters to take and transcribe the testimony and will provide the call-in information once a date and time for the deposition has been agreed upon. We will not send notices nor serve subpoenas for IME depositions. This includes cases in which extensions are needed. We will complete the initial scheduling of cases that are already in progress and we will notify you with regard to cases recently set down for depositions that you will need to arrange if we have not advised you at the hearing.
This new policy will apply to all requests for cross-examination of IMEs effective immediately.
