Board Announces New 6/7/21 Effective Date for Drug Formulary Refills and Renewals
The new effective date for refills and renewals of medications under the New York Workers’ Compensation Drug Formulary ("Drug Formulary") is 6/7/21, according to Board Subject Number 046-1371. The prior proposed rollout date was 1/1/21, but the Board decided to delay the effective date due to the COVID-19 pandemic.
As we have previously noted, the Drug Formulary contains a notice requirement for insurers, self-insured employers, and third-party administrators (payers). Under Rule 441.3, payers must notify health care providers and claimant of the new effective date before 4/1/21. The Board has provided sample notice forms to send to injured workers and health care providers in the Subject Number announcement.
