  • Coordinate claim investigations and prepare PH-16.2 Pre-Hearing Conference Statements 
  • Attend hearings at the Workers’ Compensation Board (all hearing points in the Buffalo and Rochester Districts) 
  • Conduct medical and lay witness depositions 
  • Prepare post trial briefs for submission to law judges 
  • Prepare Applications for Board Review and Rebuttals
  • Prepare, file and argue appeals to New York State Supreme Court Appellate Division Third Department and the New York Court of Appeals
  • Represent municipal employers in Line of Duty Injury claims by police and firefighters under General Municipal Law Section 207-c (Buffalo and Rochester)
  • Draft Section 32 Settlement Agreements, including negotiating of terms and drafting the C-32 
  • Calculate Medicare Set-Asides (MSAs), including process for reducing narcotic consumption/costs, and submit applications to CMS for pre-settlement approval 
  • Challenge/Negotiate Conditional Payment Recovery Demands from CMS 
  • Negotiate Third-Party Action lien resolutions, including litigation expense apportionment under Burns, and drafting of settlement consent letters preserving future offset rights 
  • Handle Loss Transfer Arbitration to recover WC payments up to $50,000 paid in lieu of first-party benefits under No-Fault Law
  • Negotiate Health Insurance Match Program (HIMP) reimbursement demands from private health insurers
  • Perform Non-Acute Pain Medical Treatment Guideline reviews and conduct depositions of physicians on MTG issues
  • Special Research Projects on workers’ compensation related topics
