Mr. Marello focuses his practice on defending employers and insurance carriers in workers’ compensation matters. He has successfully litigated claims from initial controversy through appeal. He has handled extensive trials at the Workers’ Compensation Board with both lay witness and medical testimony on various issues including accident, notice, causal relationship, period and extent of disability, entitlement to medical benefits, and loss of wage earning capacity. He routinely negotiates Section 32 settlement agreements to move claims towards closure. He has extensive experience with legal research and writing via Memoranda of Law, Applications for Board Review, and Rebuttals to Applications for Board Review. He has experience with complex claims including Section 114-a fraud claims, Loss Transfer arbitration hearings, and representing clients’ interests in third party actions before State Supreme Court and the Court of Claims.

Prior to joining Hamberger & Weiss, Mr. Marello worked for the Federal Bureau of Investigation. During law school, he clerked for the Honorable Penny M. Wolfgang of the New York State Supreme Court, the Erie County Attorney, and a solo practitioner.   Mr. Marello is a member of the Erie County Bar Association.

Mr. Marello is a native of Tonawanda, where he resides with his wife and Great Dane. An avid outdoorsmen, Mr. Marello enjoys playing sports and working on his golf game. He also proudly serves on the St. Joseph’s Collegiate Institute Alumni Association Board of Directors.
