Richard Holstein is a partner in the Buffalo, New York office of Hamberger & Weiss, the New York State member of the National Workers’ Compensation Defense Network. Hamberger & Weiss focuses its practice on the representation and defense of employers, insurance carriers, and third party workers’ compensation claims administrators before the New York State Workers’ Compensation Board. The firm also provides representation on behalf of its clients in matters intimately related to the Workers’ Compensation Law, such as Loss Transfer arbitrations, claims brought by injured police officers or firefighters under General Municipal Law §207, and lien and credit issues associated with work injuries that produce personal injury lawsuits.
Mr. Holstein has devoted 17 of the 20 years he has been practicing law to the study of the Workers’ Compensation Law, and to the representation of employers, insurance carriers, and third party workers’ compensation claims administrators before the New York State Workers’ Compensation Board. Mr. Holstein has also had experience in the representation of civil defendants in jury trials in New York State Supreme Court.
Mr. Holstein has taken it upon himself to focus on the area of workers’ compensation fraud, and in litigation regarding WCL §114-a(1) claims at the New York State Workers’ Compensation Board. He has drafted comprehensive outlines on the subject of workers’ compensation fraud and has, over the last several years, lectured on the topic all over New York State.
Mr. Holstein graduated in 1990, summa cum laude, with a B.A. degree from the State University of New York at Albany. He graduated in 1993 with a J.D. degree from the State University of New York at Buffalo, where he was also a member of the Desmond Moot Court Board. Mr. Holstein is a member of the American Bar Association, the New York State Bar Association, and the Erie County Bar Association. He resides in Boston, NY with his wife, Erin, and their 2 children. Mr. Holstein currently sits on the Town of Boston Ethics Committee, which is responsible for the consideration of alleged ethical violations by town employees.
